Probate Court

Elbert County Probate Court has exclusive jurisdiction in the probate of wills, administration of estates, appointment of guardians, involuntary hospitalizations, issuance of pistol licenses and marriage licenses.

    Bring in a copy of the signed final divorce decree or death certificate

Magistrate Court

The Elbert County Magistrate Court has jurisdiction over the trial of violations of county ordinances. It also administers any oath that is not required by law to be administered by some other officer. Committal hearings are held twice a year to determine if probable cause exists on felony cases.

The chief magistrate issues criminal warrants for the public and all law enforcement. She issues search warrants, fugitive warrants and waivers of extradition. She also sets bonds on criminal charges with the exception of charges that carry the death penalty or life in prison.

Judge Hewell issues summons, judgments and writs in proceedings of the court. She holds trials of issues for civil cases. She also issues writs of Fi Fa once judgment is obtained on civil suits.
